These terms govern the use of broadcomnegotiations.com, the public publication of an independent buyer side advisory firm. By accessing this site, the reader accepts these terms. A reader who does not accept these terms should not continue to use the site. These terms do not govern any commercial engagement between the firm and a client. Commercial engagements are governed by the engagement letter and the master services agreement signed with each client, both of which take precedence over the text on this page for any matter that arises inside an engagement.
The terms below cover access to the site, the nature of the content published here, the firm's editorial position, the limits of liability the firm accepts in connection with the site, the use of trade names belonging to third parties, and the law and forum that apply to disputes about the site itself. Where any term on this page is inconsistent with the engagement letter signed with a specific client, the engagement letter governs that client's matter.
About the publisher
This site is operated by an independent buyer side advisory firm. The firm provides services to buyers of Broadcom products and services on contract negotiation, audit defense and portfolio optimization. The firm is not affiliated with Broadcom Inc. The firm does not hold any reseller, partner, referral or marketing relationship with Broadcom Inc. or with any Broadcom channel partner. The firm's standing position on independence is set out on the independence page and reproduced in the disclosure statement.
Nature of the content
The content published on this site is editorial in nature. The articles, case studies, benchmark ranges, opinion pieces and field notes are intended to inform readers about the negotiation, audit and portfolio economics that the firm encounters in its advisory work. The content is not legal advice. It is not financial advice. It is not tax advice. It is not an offer of services to any particular buyer. A reader who needs advice on a specific matter should obtain that advice through a separate engagement with the firm or with an appropriately qualified third party.
The benchmark ranges, outcome figures and concession bands cited on the site are drawn from the firm's engagement file. They are presented as ranges rather than as point estimates because the variance inside any cohort is real. A reader who relies on a published range without engaging the firm to apply the range to the reader's own situation does so at the reader's own risk. The published ranges are intended as evidence for a buyer's preparation, not as a substitute for that preparation.
Editorial position
The firm is editorial in voice and buyer side in framing. Where the site comments on the Broadcom commercial model, the Broadcom audit posture, the Broadcom renewal calendar, or the Broadcom contract structure, the commentary is the firm's view drawn from its advisory work. The firm does not name Broadcom employees in commentary. The firm does not characterise specific Broadcom representatives in case studies or articles. The firm treats Broadcom Inc. as a counterparty in commercial relationships and reports on the commercial pattern, not on individual people.
Use of the site
A reader may read, link to and quote from the site for non commercial purposes consistent with ordinary fair use. A reader who wishes to republish substantial portions of the content commercially, syndicate the content into another publication, or use the content for any purpose beyond ordinary fair use should write through the contact form to obtain the firm's consent. The firm will respond in writing.

Contact form submissions
The contact form on the site is provided so that prospective clients can make contact with the firm. Submission of the form is voluntary. The handling of personal information submitted through the form is governed by the privacy statement. A reader who submits the form is asking the firm to consider engagement and is consenting to the firm using the submission to respond and to prepare for that conversation. Submission of the form does not create a client relationship. A client relationship begins only on the signature of an engagement letter and master services agreement by both the firm and the client.
Third party trade names
The site references Broadcom and the names of products that Broadcom acquired through prior acquisitions, including VMware, vSAN, Tanzu, Aria, Symantec, Carbon Black, CA Technologies and Brocade. The site also references third party vendors mentioned in alternative pathway analysis, including but not limited to Nutanix, CrowdStrike, SentinelOne, Red Hat, and major hyperscalers. The use of these names is for nominative reference consistent with fair and accurate identification of the products and vendors that are the subject of the firm's advisory work. The marks remain the property of their respective owners. The site does not assert any right to the marks beyond the right of nominative reference.
No warranty
The site is provided on an as is basis. The firm makes no warranty, express or implied, about the accuracy, completeness, timeliness or fitness for any particular purpose of the content on the site. The firm makes no warranty about the availability or operation of the site itself. The firm reserves the right to modify, suspend or discontinue the site, in whole or in part, at any time without notice.
Limitation of liability
To the extent permitted by applicable law, the firm and its principals, employees and agents are not liable for any direct, indirect, incidental, consequential or special loss arising from a reader's access to or use of the site, the content on the site, or any link from the site to a third party resource. Nothing in this section limits any liability that cannot be limited by applicable law.
Indemnity
A reader who uses the site in breach of these terms agrees to indemnify the firm against any third party claim that arises from that breach. This indemnity is intended to operate on its own and survives the reader's discontinuation of use of the site.
Governing law and forum
These terms, and any dispute about the site itself, are governed by the law of the firm's principal place of business as recorded in the firm's commercial registration at the time the dispute arises. Disputes about the site itself are subject to the exclusive jurisdiction of the courts of that place. Disputes that arise inside a client engagement are governed by the engagement letter and master services agreement signed with that client and the governing law and forum stated in those documents take precedence over this paragraph for that client's matter.
Updates to these terms
These terms are reviewed at least annually and updated when material facts change. Where a change is material to the reader, the firm will note the change at the head of this page for a reasonable period following the change. A reader who continues to use the site after the change is taken to have accepted the updated terms.
